Refund and Returns Policy

Thank you for choosing EWONAZ LLC for your software and web application development needs. Because our services involve customized digital development, planning, design, programming, testing, integration, and other professional work, our refund and cancellation terms are designed specifically for project-based services.

EWONAZ LLC operates primarily on a one-time payment, project-based model rather than a recurring subscription model.

This Refund and Return Policy explains when refunds may be available, when payments are generally non-refundable, how cancellations are handled, and what to do if you believe a delivered service does not meet the agreed requirements.

1. Company Information

Company: EWONAZ LLC
Website: https://ewonaz.com/
Email: info@ewonaz.com
Address: 1209 Mountain Road PL NE Ste R, Albuquerque, NM 87110, USA

Our services include:

  • Custom Software Development

  • Web Application Development

  • Business Software & Automation

  • API & System Integration

  • Related software development and technical services agreed in writing

2. One-Time Project Payment Model

EWONAZ LLC generally provides software and web application development through one-time project payments.

This means:

  • Development packages are not automatically recurring subscriptions.

  • Clients pay according to the agreed project price and payment schedule.

  • Payments may cover planning, design, development, testing, revisions, integration, and other agreed deliverables.

  • Future maintenance, additional features, hosting, third-party services, and other services are not automatically included unless specifically stated in writing.

Because software development involves professional time and resources, payments associated with completed work may not be refundable.

3. Nature of Our Services

Our services are customized digital services rather than physical products.

Depending on the project, we may perform:

  • Requirements analysis

  • Project planning

  • Software architecture

  • UI/UX design

  • Frontend development

  • Backend development

  • Database development

  • API development

  • System integration

  • Automation

  • Testing

  • Debugging

  • Deployment assistance

  • Technical documentation

  • Project revisions

Because these activities involve time and resources that are committed specifically to a client’s project, they cannot always be returned or reversed in the same way as a physical product.

4. General Refund Policy

Refund eligibility depends on:

  • The applicable project agreement;

  • The stage of development;

  • The amount of work completed;

  • The reason for cancellation;

  • Whether deliverables have been provided;

  • Third-party costs incurred;

  • Applicable law.

As a general principle, payments for work already completed are non-refundable unless otherwise agreed in writing or required by applicable law.

We encourage clients to contact us as soon as possible if they have concerns about a project so that we can attempt to resolve the issue.

5. Before Development Begins

If a client requests cancellation before meaningful project work has started, EWONAZ LLC may consider a refund of eligible unused amounts.

However, deductions may apply for costs already incurred, such as:

  • Project planning;

  • Requirements analysis;

  • Design work;

  • Administrative work;

  • Third-party purchases;

  • Payment processing fees where applicable;

  • Other project-related expenses.

Any refund will be determined based on the circumstances and the applicable project agreement.

6. After Development Begins

Once development work has started, payments may become non-refundable to the extent that they correspond to work already performed.

This may include:

  • Planning;

  • Research;

  • UI/UX design;

  • Programming;

  • Database development;

  • API development;

  • Integration;

  • Testing;

  • Project management;

  • Technical documentation.

If a project is cancelled after work has begun, the client may be responsible for payment for work completed up to the cancellation date.

7. Milestone Payments

For projects using milestone-based payments, each milestone may represent a defined portion of the development work.

Once a milestone has been completed and approved, or once the associated work has been substantially performed, payment for that milestone may become non-refundable.

If a project is cancelled before a future milestone begins, amounts specifically allocated to that future work may be considered for refund, subject to the applicable agreement and expenses already incurred.

8. Full Upfront Payments

Where a client pays the entire project amount before development begins, the payment may cover multiple development stages.

If the client subsequently cancels the project, EWONAZ LLC may determine the refundable portion based on:

  • Work already completed;

  • Resources allocated;

  • Project planning;

  • Design;

  • Development;

  • Third-party costs;

  • Other reasonable project expenses.

Payment of the full project price does not automatically create an unconditional right to a full refund.

9. Cancellation by Client

Clients may request cancellation by contacting:

info@ewonaz.com

The cancellation request should include:

  • Client name;

  • Business name, if applicable;

  • Project name;

  • Invoice or project reference;

  • Reason for cancellation;

  • Any relevant supporting information.

Upon receiving a cancellation request, we will review the project status and determine any applicable financial obligations according to the project agreement and this Policy.

10. Cancellation Due to Change of Mind

A client may change their mind about a project after development has started.

However, a change of mind does not automatically qualify the client for a full refund.

If work has already been completed or resources have been committed, those amounts may remain payable.

We encourage clients to discuss concerns with us before requesting cancellation because many project issues can be addressed through reasonable revisions or adjustments.

11. Change in Business Requirements

Businesses may change their requirements during development.

A change in requirements does not automatically qualify the client for a refund.

Instead, we may work with the client to:

  • Modify the existing scope;

  • Replace certain functionality;

  • Add new features;

  • Adjust the project timeline;

  • Provide a revised quotation.

Significant changes may result in additional charges.

12. Scope Changes and Refunds

If a client decides that they want a completely different product or functionality than originally agreed, EWONAZ LLC may treat the change as a new scope of work.

Previously completed work is generally not refundable solely because the client changes the direction of the project.

We will attempt to identify whether existing work can be reused or adapted where technically practical.

13. Design Revisions

Where revisions are included in the purchased package, clients may use those revisions according to the applicable project agreement.

A revision is not necessarily a refund request.

If a client dislikes a design or requests reasonable changes within the agreed scope, we may make those changes rather than issue a refund.

Extensive redesigns or changes outside the agreed scope may require additional fees.

14. Bugs and Development Defects

If a delivered feature contains a genuine development defect that causes it to materially fail to operate according to the agreed specifications, EWONAZ LLC may first attempt to correct the issue.

Where the issue is within our responsibility, we may provide a reasonable correction or bug fix.

A refund will generally not be the first remedy where the issue can reasonably be corrected.

15. Issues That Are Not Development Defects

A problem may not qualify as a development defect if it results from:

  • Client modifications;

  • Unauthorized code changes;

  • Third-party software;

  • Third-party API changes;

  • Hosting problems;

  • Domain configuration;

  • Server configuration outside our control;

  • Unsupported browsers or environments;

  • Incorrect client-provided information;

  • Changes in business requirements;

  • User error;

  • External service outages;

  • Failure to follow provided instructions.

Such issues may require separate technical assistance or additional fees.

16. Third-Party Services and Fees

Software projects may involve third-party services such as:

  • Hosting;

  • Domains;

  • Payment providers;

  • Cloud services;

  • APIs;

  • Plugins;

  • Software licenses;

  • Email services;

  • SMS services;

  • Analytics platforms;

  • Security services;

  • Other external tools.

Third-party fees may be non-refundable depending on the provider’s own terms.

EWONAZ LLC cannot guarantee refunds for third-party services purchased on behalf of or at the request of a client.

17. Hosting and Domain Expenses

Domain registration and hosting services are generally provided by external providers.

If these services are purchased for a client, refunds are subject to the applicable provider’s policies.

EWONAZ LLC is not responsible for a third-party provider’s refusal to issue a refund.

18. Payment Processing Fees

Where a payment processor charges transaction or processing fees, those fees may not be recoverable.

Where permitted by applicable law and depending on the circumstances, such fees may be deducted from an otherwise approved refund.

19. Client Delays

Clients are expected to provide required information, content, feedback, approvals, and access in a timely manner.

A project delay caused by the client does not automatically qualify for a refund.

Examples include:

  • Failure to provide content;

  • Delayed feedback;

  • Delayed approvals;

  • Missing credentials;

  • Unavailable decision-makers;

  • Delayed payments;

  • Failure to provide required technical information.

Where client delays significantly affect a project, the project timeline may be adjusted.

20. Failure to Respond

If a client becomes unresponsive for an extended period, EWONAZ LLC may pause the project.

Before closing or terminating an inactive project, we may attempt to contact the client using the contact information available to us.

Amounts related to work already performed may remain non-refundable.

Reactivation of a paused project may require additional time or fees depending on the circumstances.

21. Refunds for Undelivered Work

If EWONAZ LLC terminates a project for reasons unrelated to client misconduct or breach before completing work for which the client has paid, we may review the amount of unfinished work and determine an appropriate refund or credit where applicable.

Any such refund will take into consideration:

  • Completed work;

  • Work in progress;

  • Third-party expenses;

  • Non-refundable costs;

  • Applicable contractual terms.

22. Cancellation by EWONAZ LLC

EWONAZ LLC may terminate a project where the client:

  • Fails to make required payments;

  • Repeatedly fails to provide necessary information;

  • Requests unlawful activity;

  • Violates intellectual property rights;

  • Attempts to misuse our services;

  • Engages in abusive or threatening conduct;

  • Materially breaches the project agreement;

  • Creates unreasonable security or legal risks.

Where appropriate, we may provide notice before termination.

Amounts owed for completed work remain payable.

23. Refunds Due to Service Termination

If EWONAZ LLC terminates a project for a reason unrelated to client misconduct and there are prepaid amounts specifically attributable to services that have not been performed, we may review those amounts for potential refund.

Any refund will be determined according to the project agreement, this Policy, and applicable law.

24. No Automatic Refund for Business Results

EWONAZ LLC provides software development services.

A client cannot request a refund solely because the resulting software does not produce a particular business outcome.

We do not guarantee:

  • Increased sales;

  • Increased revenue;

  • Increased website traffic;

  • Increased customers;

  • Increased profits;

  • Specific conversion rates;

  • Market success;

  • Investment returns.

Business outcomes depend on many factors beyond software development.

25. No Refund for Failure to Use the Product

Once a software or web application has been delivered according to the agreed requirements, the client’s decision not to use it does not automatically create a right to a refund.

Similarly, a refund is not automatically available because:

  • Employees do not use the software;

  • Customers do not adopt the application;

  • The business changes direction;

  • The business closes;

  • The client no longer needs the software.

26. Acceptance of Deliverables

Clients are expected to review project deliverables.

Where a client approves a deliverable, uses the software in production, or confirms that the agreed requirements have been met, that deliverable may be considered accepted.

Once a deliverable has been accepted, a refund generally will not be available merely because the client later changes their preference.

This does not affect rights relating to genuine defects or rights that cannot legally be waived.

27. Final Delivery

When the agreed project has been completed, EWONAZ LLC may provide the final deliverables according to the applicable agreement.

Final delivery may include:

  • Source code where included;

  • Application files;

  • Deployment;

  • Documentation;

  • Access credentials;

  • Design files where included;

  • Other agreed materials.

Where final payment is outstanding, EWONAZ LLC may withhold final delivery until payment requirements are satisfied, subject to the applicable agreement and law.

28. Intellectual Property and Refunds

Payment and intellectual property transfer are separate issues unless the project agreement states otherwise.

Where ownership of custom deliverables is transferred upon full payment, the transfer may not occur until all applicable amounts have been paid.

A refund request does not automatically transfer ownership of unfinished or unpaid development work to the client.

29. Confidential Project Information

A refund or cancellation does not eliminate confidentiality obligations that apply to information exchanged during the project.

Both parties are expected to protect confidential information according to the applicable agreement and privacy requirements.

30. Non-Refundable Work

Unless otherwise agreed in writing, the following may generally be non-refundable once incurred or completed:

  • Requirements analysis;

  • Project planning;

  • Consultation;

  • UI/UX design;

  • Custom development;

  • Programming;

  • Database development;

  • API development;

  • Integration work;

  • Testing;

  • Debugging;

  • Technical documentation;

  • Project management;

  • Third-party purchases;

  • Hosting or domain purchases;

  • Software licenses;

  • Other completed professional services.

  • Offer corrective development work;

  • Reject the refund request where the payment is properly non-refundable.

Where appropriate, we will explain the general basis for the decision.

Processing times may depend on:

EWONAZ LLC cannot control delays caused by third-party financial institutions.

We will review the matter and attempt to resolve legitimate concerns.

Nothing in this section limits any rights you may have under applicable law or the rules of your payment provider.

36. Fraudulent Refund Requests

EWONAZ LLC reserves the right to reject refund requests that involve:

  • Fraudulent claims;

  • False information;

  • Unauthorized payment claims;

  • Abuse of refund procedures;

  • Attempts to obtain completed work without payment;

  • Manipulation of project records;

  • Other dishonest conduct.

We may provide relevant information to payment processors or appropriate authorities where legally permitted or required.

37. Consumer and Legal Rights

Nothing in this Refund and Return Policy is intended to remove or restrict rights that cannot legally be excluded or waived under applicable law.

Where mandatory consumer protection or other legal requirements provide a refund, cancellation, repair, replacement, or other remedy, those legal rights will apply.

38. Policy Changes

EWONAZ LLC may update this Refund and Return Policy from time to time.

Changes may be made to reflect:

  • Changes in services;

  • Changes in payment practices;

  • Business changes;

  • Legal requirements;
